Labour Law News In Hindi : कृषि कानून की वापसी के बाद सरकार अब श्रम कानून (Labour Law) को लेकर सतर्क है. पांच राज्यों के चुनाव में इसका गलत असर न पड़े इसके लिए फिलहाल कानून को आगे के लिए टाल दिया गया है. सरकार के सूत्रों की मानें तो नए श्रम कानून के नियमों को लागू करने में सरकार फूंक फूंककर कदम उठा रही है. यही कारण है कि सरकार सभी स्टेकहोल्डर्स से मिल-बैठकर न सिर्फ बात करना चाहती है. बल्कि कानून को लागू करने में जल्दबाजी भी नहीं करना चाहती. चुनाव में इसका असर न पड़े इसके लिए सूत्रों की मानें तो फिलहाल मजदूर संगठनों को संतुष्ट किये बिना सरकार कानून को लागू करने से बच रही है. वहीं विपक्ष कृषि कानून के बाद अब श्रम कानून के जरिये सरकार पर दबाव बना रही है. कांग्रेस का मानना है कि सरकार को नए श्रम कानून वापस लेने ही पड़ेंगे. इसके लिए विपक्ष एक बड़े आंदोलन की रूपरेखा तैयार कर रहा है.

दरअसल केंद्र सरकार ने 29 श्रम कानूनों को बदलकर 4 लेबर कोड में तब्दील कर दिया है. जिसमें सरकार ने इंडस्ट्रियल रिलेशन कोड, ऑक्यूपेशनल सेफ्टी हेल्थ एंड वर्किंग कोड, मिनिमम वेजेज कोड और सोशल सिक्योरिटी कोड सामिल हैं. ज्यादातर मजदूर संगठन इनमें से दो कोड का विरोध कर रहे हैं. पहला इंडस्ट्रियल रिलेशन कोड का, जिसके तहत मजदूरों को स्ट्राइक पर जाने का अधिकार समाप्त होता है. क्योंकि इस कोड के तहत ज्यादातर फैक्ट्रियों को एसेंशियल सर्विसेज की श्रेणी में रखा जाता है. इसी तरह ऑक्यूपेशनल सेफ्टी हेल्थ एंड वर्किंग कोड का भी विरोध हो रहा है. संगठनों के मुताबिक इस कानून के तहत अबतक 100 लेबर वाली फैक्ट्रियों को बंद करने से पहले सरकार के कई विभागों से अनुमति लेनी होती थी. जिसे अब 300 कर दिया गया है. जानकर मानते हैं कि देश में 90 फीसदी से ज्यादा ऐसी फैक्ट्रियां हैं, जिनमें 300 से कम वर्कर हैं.

ऐसे में इस नियम के तहत फैक्ट्री मालिक जब चाहेगा वर्कर को बाहर कर सकता है. जबकि दो कानूनों का ज्यादातर लोग समर्थन कर रहे हैं. इसमें मिनिमम वेजेज कोड और सोशल सिक्योरिटी कोड शामिल है. कृषि कानून के बाद सरकार सतर्क हो गई है. सूत्रों की मानें तो इस कानून के नियमों को लागू करने के लिए अब तक सरकार और मजदूर संगठनों के बीच 25 से ज्यादा बैठकें हो चुकी हैं. लेकिन अभी तक आम सहमति नहीं बन सकी है. सहमति बनने तक सरकार कोई जोखिम नहीं उठाना चाहती है.

भारतीय मजदूर संघ के राष्ट्रीय नेता पवन कुमार ने कहा कि सरकार ने 29 कानूनों को बदलकर 4 लेबर कोड बनाएं हैं. दो लेबर कोड का भारतीय मजदूर संघ ने स्वागत किया है. मिनिमम वेजेज कोड और सोशल सिक्योरिटी कोड का स्वागत किया है. हम कहते हैं इसे जल्दी से जल्दी इंप्लीमेंट कर दिया जाए. जबकि इंडस्ट्रियल रिलेशन कोड और ऑक्यूपेशनल सेफ्टी हेल्थ एंड वर्किंग कोड में सरकार को तुरंत संशोधन करना चाहिए. इंडस्ट्रियल रिलेशन कोड में वर्कर को स्ट्राइक का राइट मिलना ही चाहिए. दूसरा ओएसएचडब्ल्यू कोड में फैक्ट्री का स्वरूप बदल दिया है. इसलिए दोनों में संशोधन होना चाहिए.

एसेंशियल सर्विस के नाम पर आज बिस्किट बनाने की फैक्ट्री भी एनसीएल बन गई, साबुन बनाने की फैक्ट्री को भी आवश्यक की श्रेणी में डाल दिया. तो फिर ट्रांसपोर्ट व अन्य को किसमें रखेंगे, यह सोचने वाली बात है.
